Welcome to JEET, a free learning management system (LMS) operated by the NGO Ramakrishna Sarada Samiti (RKSS). By accessing or using the JEET platform, you agree to abide by these Terms of Use. If you do not agree, please refrain from using JEET.
1. Eligibility
- Use of JEET is open to all individuals, including students, teachers, parents, and NGOs.
- Users under the age of 18 must obtain consent from a parent or guardian.
- By registering, you confirm that the information provided is accurate and truthful.
2. Accounts
- Users must create an account to access certain features of JEET.
- It is the userβs responsibility to maintain the confidentiality of their login credentials.
- Notify JEET immediately of any unauthorized access to your account.
3. Privacy Policy
- The use of JEET is governed by our Privacy Policy, which outlines how we collect, use, and safeguard your data.
- By using JEET, you consent to the data practices described in the Privacy Policy.
4. Other Guidelines
- Users must follow additional guidelines provided for specific features, including courses, tests, and dashboards.
- Violations of these guidelines may result in restricted access.
5. Modification of the Terms
- JEET reserves the right to modify these Terms of Use at any time.
- Significant changes will be updated and may be communicated via email or notifications on the platform.
- Continued use after changes updated indicates acceptance of the revised terms.
6. User Content License Grant
- By aggregating, displaying, submitting content on JEET, users and owners of content grant RKSS a non-exclusive, royalty-free license to use, modify, and display such content solely for educational purposes with no commercial motive.
- Users and owners of content retain ownership of their content.
7. Compliance with the Indian Copyright Act
- Users and owners of content must ensure that all content uploaded complies with the Indian Copyright Act, 1957.
- JEET prohibits the use of copyrighted material without appropriate permissions and can unconditionally without notice pull down any such content, which is non-compliant.
8. Proprietary Materials; Licenses
- All content and materials provided by JEET, including text, graphics, videos, and software, may or may not be the proprietary property of RKSS.
- Users are granted a limited, non-transferable license to use the platform solely for educational purposes, free for a lifetime.
9. Prohibited Conduct
Users must not:
- Upload or share harmful, illegal, or inappropriate content.
- Attempt to gain unauthorized access to the platform or other accounts.
- Use JEET for commercial purposes without permission.
- Violate applicable laws or regulations.
10. Third-Party Sites, Products, and Services; Links
- JEET may include links to third-party websites (e.g., NCERT, CBSE, YouTube). These links are provided for informational and educational purposes only without commercial motive.
- JEET does not endorse or take responsibility for third-party content or services.
11. Term and Termination
- These Terms remain effective until terminated by JEET or the user.
- JEET reserves the right to suspend or terminate access for any user who violates these Terms.
12. Representations and Warranties
By using JEET, you represent and warrant that:
- You comply with all applicable laws.
- You will not misuse the platform for unauthorized purposes.
13. Indemnification
Users agree to indemnify and hold harmless RKSS and its affiliates from any claims, damages, or liabilities arising from violations of these Terms or misuse of the platform.
14. Disclaimers; No Warranties
- JEET is provided on an "as-is" basis without warranties of any kind.
- RKSS does not guarantee uninterrupted or error-free use of the platform.
15. Limitation of Liability and Damages
- RKSS shall not be liable for any indirect, incidental, or consequential damages arising from the use of JEET.
- Total liability, individual or several, for direct damages will not exceed INR 1,000.
16. Miscellaneous
Dispute Resolution and Mediation:
- Any disputes arising under these Terms will be resolved amicably through the mediator who will be one of the Advisors of RKSS in Mumbai, India, under the The Mediation Act, 2023. Reasonable endeavours shall be made to resolve dispute amicably through the mediator within 60 days.
- The settlement arrived at among the parties in the said mediation process shall be final and binding on the parties.
Governing Law:
- These Terms are governed by the laws of India.
Severability:
- If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force.
